1. The implications of this Privacy Policy to the Site’s user
This Privacy Policy covers how Nichebury and all of its affiliated websites, products and services (collectively, the “Services”) treats user or personally identifiable information that the Services collect and receive. However, note that this Privacy Policy does not apply to the practices of associate companies that Nichebury has no ownership or control over, including the people that it does not manage or are not in its employ.

2. General information
In general, a user can visit the Site without telling Nichebury who he/she is or revealing any information about himself/herself. Nichebury does not collect personally identifiable information (“PII”) about individuals, except when specifically and knowingly provided by such individuals on interactive areas of the Site. PII is information that is not publicly available and can be used to uniquely identify, contact, or locate a single person. For example, name, postal address, e-mail address, phone number and credit card number, among other information. Any posting made while using the Site and Services can be viewed by the public and is therefore not classified as PII. This type of information is not protected by the Privacy Policy.

3. Information collected
3.1. Personally Identifiable Information (“PII”).
3.1.i. Such information collected includes name, postal address, e-mail address, credit card number and related information and phone number. Nichebury maintains a record of all information that a user submits to it, including e-mail and other correspondence. PII may be collected when a user registers posts content on the Site, purchase products or other services or participates in other activities offered or administered by Nichebury.

3.1.ii. PII may also be collected about a user’s transactions with Nichebury and with some of our business associate entities. This information might include information necessary to process payments due to Nichebury from a user, such as a user’s credit card number.
3.1.iii. Nichebury does not intentionally or knowingly collect PII about children under the age of 13 (Thirteen). For further details in this regard please refer the section “Privacy of Children” below.
3.2. Other User Information.
As it is usual with most websites, the Site too receives and records information on its server logs from a user’s browser automatically and through the use of electronic tools such as cookies. The Site’s server logs automatically receive and record information from a user’s browser (including, for example, a user’s IP address, and the page(s) he/she visits). The information gathered through these methods is not classified as “personally identifiable;”. That is, it cannot be used to uniquely identify, contact, or locate the user.

4. How Nichebury uses a user’s information
Nichebury will use a user’s information only as permitted by law, and subject to the terms of its Privacy Policy:

4.i. Use of Personally Identifiable Information (“PII”):
Nichebury does not sell or share a user’s PII with unrelated third parties for their direct marketing purposes.

4.ii. PII and other personal information a user specifically provides may be used:
To provide the Services the Site offers, to process transactions and billing, for identification and authentication purposes, to communicate with the user concerning transactions, security, privacy, and administrative issues relating to his/her use of the Site and Services, to improve Services, to carry out some service a user has specifically requested to do, or to tell a user of Services that Nichebury thinks may be of interest to him/her.
a. to communicate with a user regarding the Site and Services.
b. for the administration of and troubleshooting regarding the Site.
Certain third parties who provide technical support for the operation of the Site (such as the web hosting service, for example), may need to access such information from time to time, but are not permitted to disclose such information to others.

4.iii. Circumstances under which Nichebury may disclose a user’s PII include the following:
In the course of doing its business, it may be necessary or appropriate for Nichebury to provide access to a user’s PII to other entities such as its service providers, contractors and select vendors so that it can operate the Site and its business. Where practical, Nichebury will seek to obtain confidentiality agreements consistent with this Privacy Policy and that limit others’ use or disclosure of the information a user has shared.
Nichebury may also share a user’s PII if it is required to do so by law or in good faith, it is of the opinion that such action is necessary to achieve the following: (1) comply with the law or with legal process (such as pursuant to court order, subpoena, or a request by law enforcement officials); (2) protect, enforce, and defend its Terms of Use, rights and property; (3) protect against misuse or unauthorized use of the Site; or (4) protect the personal safety or property of other Sites’ users or the public. Among other things, this means that if a user provides false information or attempts to pose as someone else, information about the user may be disclosed as part of any investigation into his/her actions.

4.iv. Use of Anonymous Information:
Certain information that Nichebury collects automatically or with electronic tools, like cookies, is used to anonymously track and measure user traffic to the Site and to enhance the user’s experience on the Site. For instance:
IP Addresses/Session Information. On occasion Nichebury may obtain IP addresses from users depending upon how a user accesses the Site. IP addresses, browser, and session information may be used for various purposes, including to assist administer the Site, diagnose and prevent service or other technology problems related to the Site. This information also may be used to estimate the total number of users visiting the Site from specific geographical areas, to help determine which users have access privileges to certain content or services that the Site offers, and to monitor and prevent fraud and abuse. IP addresses are not linked to PII.

4.v. Cookies:
A cookie is a small amount of data that often includes an anonymous unique identifier that is sent to a user’s browser from a website’s computers and stored on the user’s hard drive. A user can configure his/her browser to accept cookies, reject them, or notify him/her when a cookie is sent. If a user rejects cookies, he/she may not be able to use the Site’s Services that require him/her to sign in, or to take full advantage of all the Site’s offerings. Cookies may involve the transmission of information either directly to Nichebury or to another party Nchebury authorises to collect information on its behalf. Nichebury may use its own cookies to transmit information for a number of purposes, including to:
a.    require a user to re-enter his/her password after a certain period of time has elapsed to protect him/her against others accessing his/her account contents;
b.    keep track of preferences the user specifies while using the Site;
c.    estimate and report the Site’s total audience size and traffic;
d.    conduct research to improve the content and services provided on the Site.
Nichebury allows other entities that show advertisements on the Site’s web pages to set and access their cookies on the user’s computer. Other entities’ use of their cookies is subject to their own privacy policies and not this Privacy Policy. Advertisers or other entities do not have access to the Site’s cookies.
Nichebury may share anonymous information aggregated to measure the number of visits, average time spent on the site, pages viewed, etc. with its business associates, advertisers and others entities.

5. Site postings are generally accessible to the public
A user’s own use of the Site may disclose personal information or Personally Identifiable Information to the public when posting information on the Site for viewing by all visitors, for instance. Unless the sponsor or host of a Service selects a privacy setting that restricts public access. Please remember that any information disclosed on a non-restricted Service becomes public information and may be collected and used by others without Nichebury’s knowledge. Therefore, a user should exercise caution when disclosing any personal information or Personally Identifiable Information in these forums.
When posting a message to any message board, blog, or other public forum on the Site, a user’s user ID or alias that he/she is posting under may be visible to other users. And a user has the ability to post a message that may include personal information.
If a user posts Personally Identifiable Information online that is accessible to the public, a user may receive unsolicited messages from other parties in return. Such activities are beyond the control of Nichebury and this Privacy Policy. Users are cautioned to please be careful and responsible whenever they are online. In addition, although Nichebury employs technology and software designed to minimize spam sent to users and unsolicited, automatic posts to message boards, blogs, or other public forums on the Site, it is not possible to ensure such measures to be foolproof or satisfactory.

6. Children’s Privacy
Since the Site offers content that is suitable and may prove highly appealing to children, collection of the PII for children under the age of 16 years shall be on condition that the express written consent of the child’s parent/legal guardian had been received prior, including the conditions under which such information shall be used and maintained.
Although Nichebury undertakes to apply these children's privacy terms whenever it becomes aware that a user who submits PII is less than 16 years old, no method is foolproof. Therefore, Nichebury encourages parents and guardians to supervise their children's online activities and consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent children from disclosing online their name, address, and other personal information without parental permission. PII collected from children may include any of the information defined above as PII with respect to general users of the Site, and may be used by Nichebury for the same purposes. Except as necessary to process a child's requests or orders placed with advertisers or merchants featured on the Site, Nichebury does not rent, sell, barter or give away any lists containing a child's Personally Identifiable Information for use by any outside company.
It is within the rights of a parent or legal guardian of a child to request Nichebury to disclose a description of the Personally Identifiable Information that it has collected from the child, as well as instruct Nichebury to stop further use, maintenance and collection of Personally Identifiable Information from the child concerned. If a child voluntarily discloses his or her name, e-mail address or other personally-identifying information on chat areas, bulletin boards or other forums or public posting areas, such disclosures may result in unsolicited messages from other parties.

7. Information ownership
Copyright is expressly reserved. 8. Security measures
The security and confidentiality of a user’s Personally Identifiable Information is extremely important to Nichebury. For this reason measures have been put in place to safeguard it. These include technical, administrative and physical security measures to protect user information from unauthorized access and improper use. From time to time, Nichebury shall review its security procedures in order to consider appropriate new technology and methods. However, the users are made aware that despite these best efforts, no security measures are perfect or foolproof. Consequently, Nichebury cannot ensure or warrant the security of any information a user transmits to the Sites. The user does so at his/her own risk.

9. Correcting, updating and changing information
A user may modify and correct Personally Identifiable Information provided directly to Nichebury for the Sites if necessary. The following options are offered for this purpose:

10. How to opt-out
A user no longer interested may opt out of receiving future mailings or other information from the Sites by detailing the type of information he/she no longer wishes to receive. This may be forwarded using the options described above (item 9).

11. Advertisements and Links
The Site may contain links to other websites that may be of interest to its visitors. This Privacy Policy applies only to Nichebury and not to its business associates or other entities to which it links. Nichebury is not responsible for the content or the privacy practices of other sites.
Though Nichebury manages the placement of advertisements on the Site, it may allow third party advertisers (“TPAs”) to do the same. TPAs may use cookies and other technical means to collect information (not user PII though) about the user’s visits to the Site and other websites for advertising strategy purposes. Therefore, users are alerted that in the event they clicked on a TPA’s website link, Nichebury’s Privacy Policy will not apply to any Personally Identifiable Information collected on the concerned TPA’s website. Users are encouraged to read the privacy policy posted on the link website to see how their Personally Identifiable Information will be handled

12. Amendments to this Privacy Policy
Nichebury will review and update this Privacy Policy on a regular basis to keep it current and relevant. Therefore, users are encouraged to review this Privacy Policy whenever they provide information on the Site. Nichebury accepts that by using the Site, users have accepted the Privacy Policy as amended.
